Former Gov. Perry was indicted on August 15, 2014 by a Travis County grand jury.
The court found an issue with the second count that alleges Perry “violated Penal Code 3 section 36.03(a)(1)—“Coercion of Public Servant”—”, where Perry’s lawyers argued that the count violated Perry’s First Amendment right to freedom of speech.
The criminal count was charged following a 2013 alleged abuse-of-power where Perry was accused of threatening to veto $7.5 million dollars worth of funding to the Travis County Public Integrity Unit unless District Attorney Rosemary Lehmberg resigned, following a drunk driving conviction.
When Lehmberg did not resign, Perry followed through with the veto.
The Appeals court upheld the first count, accusing Perry of the indictment, “Abuse of Official Capacity”, which will go forward with trial.
