Judge rules in favor of Thomas Alter

SAN MARCOS– Hays County Judge Alicia Key denied Texas State’s motion to limit the scope of Thomas Alter’s lawsuit against the university, the Texas State Employees Union (TSEU) announced in a Sept. 24 Instagram post.
This decision was made this past Monday, Sept. 21, nearly one month after his hearing that was held on Aug. 27.
“This is a huge win for accountability and once again shows the weakness of the state’s case,” a TSEU spokesperson said.
The denial of the motion allows Alter’s reinstatement at Texas State to be included in the lawsuit. Texas State President Kelly Damphousse and provost Prenash Aswath must also remain as defendants in the case.
In Sept. 2025, Alter was abruptly fired by the Texas State Board of Regents after making comments against the U.S. government at a digital socialist conference.
A Hays County district judge temporarily allowed Alter to be reinstated with pay, but blocked him from teaching classes, handing the decision over to the TXST Board of Regents, Damphousse and Aswath.
Two weeks later, Damphousse determined the university would uphold Alter’s termination effective immediately.
The next hearing of Dr. Thomas Alter v. Texas State University System is Oct. 22 at the San Marcos courthouse, with the court support demo starting at 8:30 a.m.
