Limiting Liability on Hiring Ex-Felons Lindsey Broyles
House Bill Eleven-88 would protect businesses from being sued for negligently hiring a former felon. Backers of this bill aim to reintegrate ex-felons into society without employers bearing total liability for the ex-felons. The bill does not protect employers who hire those with sexually violent convictions, or those working in similar conditions to where they committed previous offenses. San Marcos Chief of Police Howard Williams says many employers are wary to hire former felons:
“It’s very difficult for a lot of businesses to make that determination. They may really want to help somebody who indicates that they just want a job, they want to work, they want to make amends for what they’ve done, and yet they have a very reasonable fear that they may do something that now the employer becomes responsible for.”

The bill is pending in committee, but will be enacted immediately if it’s passed.
